By accessing or using the OrbitHome service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. The Service is offered by OrbitHome ("we," "us," or "our").
OrbitHome provides a web-based energy monitoring and management platform. The Service includes real-time energy monitoring, device tracking, cost estimation, solar production tracking, and related features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
You must create an account to access most features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 16 years old to create an account. You agree to provide accurate information and keep it current.
Certain features require a paid subscription. Subscription fees are billed monthly or annually in advance. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods, except as required by law.
You agree not to: (a) use the Service for any illegal purpose; (b) attempt to gain unauthorized access to any part of the Service; (c) reverse engineer, decompile, or disassemble the Service; (d) use automated tools to scrape or extract data from the Service; (e) interfere with the proper operation of the Service.
Energy data and cost estimates provided by OrbitHome are for informational purposes only. We do not guarantee the accuracy of data from third-party sources (utility providers, smart devices). Cost estimates are based on rates you provide and may differ from actual bills.
All content, designs, and code in the Service are owned by OrbitHome or its licensors and protected by intellectual property laws. You retain ownership of data you provide but grant us a license to use it to provide the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORBITHOME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless OrbitHome and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Data retention follows our Privacy Policy.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before taking effect. Your continued use after changes constitutes acceptance of the new Terms.
